I agree and understand that by signing the Electronic Signature that all electronic signatures are the legal legal effect as a handwritten signature.

In consideration for Florida Coastal Prep LLC (hereafter “FCP”) accepting the enrollment of Participant in a program and/or permitting Participant access to or the use of the property, facilities, parking lot, buildings, fields, equipment, housing, dining areas, and/or services of FCP Participant and his/her Parent/Guardian, on behalf of Participant(hereinafter “Releasors”), hereby release FCP its affiliated companies and all of its, members, directors, officers, employees, volunteers, sponsors, independent contractors or agents, for any liability, claims, actions, damages, costs, expenses or lawsuit whatsoever, arising out of or in any way connected with Participant’s enrollment and participation in the program or the use of any FCP service or facility by Participant and/or his/her guests, relatives or family members. The scope of this Waiver and Release shall include, but is not limited to, any damages, losses or injuries in connection with transportation, food, lodging, medical concerns (physical and emotion), entertainment, photographs, athletic activities and physical injury of any kind that arise from Participant’s own acts, the acts of third persons/parties, the effect of the condition of any property, equipment, or premises, or any acts of FCP's own negligence, or the negligence of any FCP officer, employee, agent, or anyone else whose conduct may be attributed to FCP. The Releasors further agree that this Wavier and Release shall remain effective throughout Participant’s enrollment in any FCP program or participation on its property or using its facilities at any time.

Acknowledgment

The Releasors acknowledge that he/she/they received the opportunity to review this Waiver and Release. The Releasors further acknowledge to have carefully read and fully understand the contents of this Waiver and Release and have asked and received answers to all questions he/she/they may have and that the Releasors have duly executed this Waiver and Release freely and voluntarily, intending and agreeing to be fully bound by the terms. If any portion is held invalid, the remaining portion of the Waiver and Release will continue in full legal force and effect.

Dispute Resolution

All claims or disputes between the Participant and/or the Participant’s Parent(s)/Guardian(s) and FCP, its employees, agents, officers, members, or affiliates, including those arising out of or related to this Agreement or arising out of or related to the Participant’s activities with FCP such as, without limitation, any claim based on breach of contract, breach of duty, negligence, gross negligence, fraud, or misrepresentation (collectively the “Disputes”) will be resolved through a civil lawsuit filed in Okaloosa County, Florida. No claims may be brought in any forum on behalf of any putative class. The costs of any arbitration brought by FCP to enforce any provision of this Agreement, including but not limited to attorneys’ fees, shall be reimbursed by the Participant and/or the Participant’s Parent(s)/Guardian(s) to the extent that FCP is the prevailing party.

For Players

I understand and acknowledge the fact that I am required to have individual health and accident insurance in case of injury, including sports related injuries, while involved in any activity related to Florida Coastal Prep. As a player for Florida Coastal Prep, I understand that it is mandatory for me to be able to show proof of individual health and accident insurance in case of an injury.

For Parents

I understand and acknowledge the fact that my child is required to have individual health and accident insurance in case of injury, including sports related injuries, while involved in any activity related to Florida Coastal Prep. As a player for Florida Coastal Prep, I understand that it is mandatory for me to be able to show proof of individual health and accident insurance in case of an injury.

Florida Coastal Prep cannot guarantee any player a scholarship, financial assistance, or anything of related to scholarship money. The only thing that we can offer is playing time and the opportunity to play in front of college coaches, whether that be D1, D2, D3, Junior College D1, Junior College D2, and/or NAIA. We are not held responsible for how a player performs during games. We reserve the right to play players how, when and in what games we see fit. Not every player is guaranteed to play in every game and/or event.

If at any time a player causes problems with the coaches, housing, mentors, spectators, and/or players we have the right to punish players as we see fair. If players continue to cause problems we reserve the right to send a player home with the possibility of no return. If this happens, all payments will seize if payments are up to date. If payments are not up to date, the overdue payments are still due and legal action may be necessary. In order to secure a place at Florida Coastal Prep a deposit must be made. Deposits are non-refundable. All payments are due the 1st of every month until the entire bill is paid, no exceptions. These payments begin according to the Cost of Attendance Payment Program and payments are due on the 1st of each month, unless given another date or if a player is to start late. If a player’s payment is overdue, we reserve the right to suspend the player and send the player home and possibly ask him not to return. Suspension will last for 3 days and include meals. At the end of the 3 days the player will be responsible for arranging travel home and taking their belongings with them.

Florida Coastal Prep is not a school. Florida Coastal Prep is a basketball program. All schooling and/or educational assistance is outsourced. Food is not provided on trips and/or at housing locations unless specifically addressed. A player may not sue due to not getting in school, the housing, when and where a player was played, and/or the terms in which a player was dismissed from the academy.

Florida Coastal Prep is a drug-free program with a longstanding commitment to provide a safe, quality-oriented and productive environment consistent with the standards of the community in which the company operates. Alcohol and drug abuse poses a threat to the health and safety of persons at Florida Coastal Prep and to the security of the company’s equipment and facilities. We reserve the right to drug test personnel when we suspect drug abuse. By signing up, you are agreeing that you understand the Terms and Conditions as seen above. You are also agreeing that you are either the player or parent who will take financial responsibility for the tuition. If you are a player you are agreeing that you are at least 18. Although you are not legally bound to enroll at Florida Coastal Prep, you are legally responsible for understanding these Terms and Conditions if you enroll. If any provision in these Terms and Conditions is held invalid, the remainder of these Terms and Conditions shall continue to be enforceable.

If any provision in these Terms and Conditions is deemed unlawful, void or unenforceable, then that provision is deemed severable from these Terms and Conditions and the remaining provisions are still valid and enforceable.

I hereby consent and authorize Florida Coastal Prep to take, use, distribute, promote, and/or sell photographs, videos, demonstrations on video or photograph(s). Florida Coastal Prep is authorized to produce videotapes, audiotapes, closed circuit television programs, social media promotions, webcasts, YouTube videos, Podcasts, or other types of media productions that capture my name, voice, and/or image of me (any type of media are called the "Products" in this Consent and Release Form). I authorize Florida Coastal Prep to copyright the materials, and I authorize Florida Coastal Prep to use, reuse, copy, publish, post, share, display, reproduce, license to a third party, and distribute the Products in any promotional or educational materials or other forms of media, which may include, but are not limited to social media, pictures, recruiting brochures, websites, publications, catalogs, articles, or magazines, electronic or otherwise, without prior notification. I certify that I have read the Media Consent and Release Liability statement and fully understand its terms and conditions.
